5. Intellectual Property

If you send us comments, story tips, questions, feedback, photos, documents, pitches, or other materials (“Submissions”), you represent that you have the right to provide them.

Unless we agree otherwise in writing, you grant AI x Average a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, adapt, publish, translate, distribute, display, and create derivative works from your Submissions for operating, promoting, and improving the Services.

Do not send confidential, proprietary, or sensitive information unless we have specifically requested it and agreed in writing to handle it confidentially. We cannot guarantee that unsolicited Submissions will be kept confidential.

We may, but are not required to, review, remove, edit, publish, or respond to Submissions.

7. Third-Party Links and Services

The Services may link to third-party websites, products, platforms, advertisers, sources, and services. These links are provided for convenience and informational purposes only.

AI x Average does not control and is not responsible for third-party content, privacy practices, security, availability, products, services, or policies. Your use of third-party services is governed by their own terms and privacy policies.

8. Advertisements, Affiliate Links, and Sponsored Content

AI x Average may display advertisements, include affiliate links, publish sponsored content, accept partnerships, or receive compensation connected with certain content or links.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR AVAILABLE AT ALL TIMES, OR THAT ANY CONTENT WILL BE COMPLETE, RELIABLE, OR SUITABLE FOR YOUR NEEDS.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, some of the exclusions above may not apply to you.

To the maximum extent permitted by law, our total liability for any claim arising from or relating to the Services or these Terms will not exceed the greater of:

  • The amount you paid to AI x Average for the Services in the 12 months before the event giving rise to the claim; or
  • US $100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless AI x Average and its owners, employees, contractors, contributors, partners, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses—including reasonable attorneys’ fees—arising out of or related to:

  • Your use or misuse of the Services.
  • Your violation of these Terms or applicable law.
  • Your infringement or violation of another person’s rights.
  • Your Submissions or other content you provide through the Services.

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, sale of assets, financing, reorganization, or similar transaction.

These Terms, together with any policies referenced in them, form the entire agreement between you and AI x Average regarding the Services.
